Types of Licenses for F & B (Food & Beverages) Businesses

1. TDUP LICENSE

TDUP (Tanda Daftar Usaha Pariwisata) is a business license that must be owned by several types of businesses related to the tourism sector, such as the business of Travel Services, Accommodation Provision, Tourist Services, Organization of Meetings (EO), Catering, Lodging (hotels, villas and similar buildings) and Food and Beverage Provision Services. Well, for those in the F&B business, aka food and beverages, ensure you have a TDUP Permit! If your F&B business has no permit, you are prohibited from running the business.

Requirements for Making a TDUP Permit

You can apply for a TDUP Permit at the local investment or PTSP office. You can apply for the F&B Business License online, but only in big cities. Most small towns in Indonesia have to apply directly to the local office. The following are the documents you need to prepare to obtain the TDUP Permit:

  • Copy of ID card and NPWP or TIN of the founders/shareholders
  • 3×4 and 4×6 photos of the directors, 4 sheets each with a red background
  • Company seal
  • Deed of Establishment
  • SK Kemenkumham
  • Company seal
  • SKDP (Company Domicile Certificate)
  • Letter of no objection from neighbours, known to the local RT / RW
  • Photocopy of IMB (Building Construction Permit) of the business premises, proof of payment of last year’s PBB, and proof of ownership or use of the business premises. If the business is self-owned, include a photocopy of the certificate and proof of payment for last year’s PBB. Suppose the location of the business premises you occupy is a rental. In that case, it is evidenced by a lease agreement between the tenant and the owner of the premises. If the location of your F&B establishment is in a building, you can prove it with a building certificate.
  • Curriculum vitae of directors and all staff
  • Company organizational structure
  • Business location plan and office layout
  • Photos of the office inside and out and company profile
  • Company NPWP
  • Company Registration Certificate and or NIB
  • Environmental Management Statement Letter (SPPL)

2. TRADE BUSINESS LICENSE

A Trade Business License is granted by the minister or a designated official to entrepreneurs to conduct business in trade and services. Based on the Regulation of the Indonesian Minister of Trade No.46/2009, a Trade Business License is required for every business with a net worth of more than IDR 50,000,000 (excluding the land and building where the company is located). However, businesses with a net worth below IDR 50,000,000 can apply for a Trade Business License if the business actor wishes, for example, in order to fulfil the requirements for obtaining a loan.

Requirements for Making a Trade Business License

  • First, you have to fill out the form.
  • Copy of business license (SITU) and nuisance permit (HO)
  • Data on equipment, production capacity, capital and manpower/fill-in form of the Trade Business License (SIUP)
  • Rp 6,000.00 stamp as many as 2 pieces
  • For the addition of business sub-fields, fill in the sub-field addition form.

If your business entity is a PT or Cooperative, there are 4 additional requirements for making this Trade Business License:

  • Decree of the Minister of Law (specifically for PT)
  • Decree of the Minister of Cooperatives (specifically for cooperatives)
  • Deed data
  • Copy of ID card of Commissioner and Director
