Application of KITAP and Residence Permit in Indonesia

Corporate Secretary Service Indonesia – Kartu Izin Tinggal Tetap (KITAP) is a permanent residence visa in Indonesia. It allows foreigners to stay longer in the country without frequent visa extensions. This visa validates for five years; foreigners must fulfil some eligibility requirements. Without this visa, foreigners must renew or extend their visas monthly, quarterly, or annually. It will depend on your visa type. KITAP can be extended.

It is important to note that you cannot work with Permanent Stay Permit (KITAP) and KITAS within the country. You will still need to apply for a work permit to seek full-time employment in Indonesia.

Who Can Apply for a Stay Permit and KITAP in Indonesia?

To qualify for this visa, you must fulfil some requirements. Generally, only those previously on a KITAS (short-term stay permit) visa can apply. However, the duration and number of KITAS extensions vary.

Eligible candidates include foreigners:

  • With a spouse who is an Indonesian resident
  • Who intends to retire in the country
  • Commissioners, investors or directors. They must be in a PT PMA (Indonesian Limited Liability Company)
  • Indonesians who wish to regain citizenship
  • Someone who holds a Temporary Residence Permit

KITAP granted to foreigners can also be given to (granted directly without going through transfer status):

  • Ex-subjects of children with double nationality of Indonesia who choose foreign nationality;
  • Kids that were born in Indonesia to a foreigner holding a permanent residence permit and;
  • Indonesian citizens who lost their Indonesian citizenship in the Indonesian Territory.

KITAP application is submitted by filling out the application form and attaching the following:

  • valid National Passport;
  • photocopy of valid Limited Stay Permit;
  • Domicile certificate;
  • integration statement signed by the person concerned, and
  • Recommendations from relevant government agencies and/or institutions.

KITAP is granted for five years and can be extended indefinitely as long as the Stay Permit is not withdrawn.

Foreign Workers/TKA (Tenaga Kerja Asing) applies to transfer KITAS status to Permanent Stay Permit (KITAP) by filling out the application form and attaching the following:

  • Domicile certificate issued by the Population and Civil Registration Office;
  • A valid National Passport containing the impression of a Limited Stay Permit;
  • KITAS;
  • KITAS or KITAP for foreign citizen Insurer or Person in Charge;
  • Statement of Integration except for children under 18 years old and unmarried; and
  • Sufficient power of attorney if the application is submitted through a power of attorney.

In addition, foreign workers must also provide:

  • A permit to employ foreign workers from the government agency that organizes government affairs in the field of manpower;
  • KITAS, which reveals that the individual concerned has stayed more than three consecutive years in the territory of Indonesia; and
  • The position concerned is that of the highest company head or the head of the representative of a foreign company operating in Indonesian territory.

This means that to obtain KITAP, foreign workers who have KITAS must have been domiciled for more than 3 (three) consecutive years in Indonesia, signed a Statement of Integration with the Government of the Republic of Indonesia, and occupy the position of the highest leadership of a company or the head of the representative of a foreign company operating in Indonesia.

If you are applying for Permanent Stay Permit (KITAP) as an investor, you must:

  • Be an investor who serves as a commissioner or director with a minimum temporary holding of IDR 1 billion (or the equivalent in US Dollars).
  • Suppose you are not serving as a commissioner or director. In that case, you must be an investor with a minimum temporary holding of IDR10 billion (or the US Dollar equivalent).

When applying for KITAP as an Investor, you must present the following documents along with the application form:

  • Passport and/or IMTA (Izin Mempekerjakan Tenaga Asing) or Foreign Worker Employment Permit
  • Valid KITAS
  • Domicile letter
  • Integration statement letter
  • Letter of recommendation from the relevant government
